بعد از قتل ریحانه جباری توسط دولت
جمهوری اسلامی در روز گذشته دیگر شکی وجود ندارد که قاتل نه خانواده سربندی بلکه
قوانین شریعت اسلامی است که قصاص را جایز، و تصمیم گیری در مورد آن را هم به
خانواده مقتول ارجاع کرده؛ وقتی حتی قوه قضائیه و
قوه مجریه کشور هم تمایلی به اجرای
حکم نداشتند.
در جهان متمدن حتی کشورهائی که در
آنها مجازات اعدام از بین نرفته است هیچگاه تصمیم مرگ و زندگی قاتل را در اختیار
خانواده مقتول قرار نمی دهند، که در سوگ است و خواستار انتقام. اگر کسی بدون هیچ
قصدی، فرزند شما را بکشد، مگر آنکه انسان فوق العاده ای باشید، خواهان نابودی قاتل
خواهید بود. به همین علت رسوم قبیله ای عهد عتیق را دولتهای متمدن جهان قرنهاست در
قوانین خود ندارند هر چند اکثر مردم آن کشورها از نظر مذهبی به مذاهب کهن معتقدند.
در چند روز اخیر علاوه بر اعدام
ریحانه جباری، اسیدپاشی به صورت دختران "بدحجاب" نیز فاجعه دیگری بود که نتیجه طرح
قوانین شریعت در مجلس شورای اسلامی ایران برای حمایت از آمران به معروف و ناهیان از
منکر است. به عبارت دیگر مسؤل اسیدپاشی نیز عدم جدایی دولت و شریعت اسلامی است.
پس از رویدادهای چند روز گذشته،
مذاکرات با آمریکا برای برچیدن تحریمهای بین المللی به جایی نخواهد رسید، چرا که بی
اعتمادی به جائی رسیده که گوئی غرب با داعشی دیگر در ایران روبروست که بجای یزیدیان
اولین قربانیانش
زنان ایران هستند. و بدینگونه عدم جدائی دولت و شریعت که به تشدید
تحریمهای بین المللی دامن زده باعث بحران
اقتصادی شدیدی در ایران می شود که دیگر جمهوری
اسلامی، نه با دختربچه های معصوم دبیرستانی که کمی موهایشان از روسری بیرون افتاده
بلکه با اعتصابات طبقات محروم جامعه روبرو خواهد شد. تنها برنده شکست مذاکرات هم
آنهایی هستند که دلارهای مخفی شده دارند که قیمتش بالا خواهد رفت.
پیش از سالگرد انتخاب شما به ریاست
جمهوری، وضعیت ایران دقیقاً توضیح داده شد
(1). متأسفانه امروز
همه آن واقعیتهای مورد اشاره در آن بررسی بدتر شده که
بهتر نشده است.
وقت آن رسیده که دولت و شریعت اسلامی
از هم جدا شوند. ممکن است بپرسید که آیا این کار به معنی پایان دادن به جمهوری
اسلامی نیست؟ پاسخ هم آری و هم نه است. آنچه دستاوردهای جمهوریت در 30 و چند سال
گذشته بوده است پایان نخواهد یافت و تقویت هم خواهد شد، بویژه که مردم ایران پس از
دوم خرداد برایش مبارزه کرده اند. اما آنچه تداخل دولت و شریعت است، پایان خواهد
یافت. این امر لزوماً به معنی خون و خون ریزی نیست. روسیه و کشورهای بلوک شرق،
دولت کمونیستی را بدون خونریزی پایان دادند و اتفاقا کسانی نظیر گورباچف و یلتسین که خود
شخصیت های بالای حزب کمونیست بودند این مهم را به انجام رساندند و از انقلابی خونین
جلوگیری کردند. امیدوارم در ایران نیز چنین شود.
همانطور که 9 سال پیش، یعنی سه سال
پیش از جنبش سبز، این بحث مطرح شد و متأسفانه آقایان موسوی و کروبی به آن توجه
نکردند، همه نیروهای سیاسی ایران در
تحول آینده ایران سهیم خواهند بود چه آنها که امروز در
قدرت شرکت دارند و چه آنها که
بیرون از قدرت قرار دارند و لازم است که همه با هم کار کنند قبل از آنکه قیامی کور
و خونین همه ایران را در آتش خود بسوزاند (2).

Mr. Hassan Rouhani, President of Iran,
After the murder of Reyhaneh Jabbari yesterday by the state
of Islamic Republic of iran there is no doubt anymore that her killer were not
the Sarbandi's family but was rather the laws of Islamic Shari'a which
prescribe Qesas to be legitimate and relay the decision to the victim's family,
when both Judiciary and executive powers were reluctant to go ahead with the
execution.
In the civilized world, even in countries that still uphold
the capital punishment, never the decision of life and death of the killer is
relegated to the family of the victim who are in mourning and feel revengeful.
If someone without any intention kills your child, unless one is an
extraordinary person, would want the destruction of the killer. This is why the
Ancient tribal customs have not been present in the laws of civilized countries
for centuries although religiouswise most of the people in these countries still
believe in the old religions.
In the last few days, beside the execution of Reyhaneh
Jabbari, acid throwing to the face of so-called "bad-hijab" girls was another
catastrophe which was the result of introducing another Shari'a law to protect
the thought police who think they are supposed to tell people what is good and
what is a vice. In other words, the lack of separation of state and Islamic
Shari'a is also responsible for the acid throwing attacks.
After the events of the last couple of days, the
negotiations with the US to end the international sanctions will not get
anywhere, because the lack of trust has reached a point as if the West is facing
another Daesh in Iran, which has its victims, not the Yazidis, but the women of
Iran. And this way, the lack of separation of state and Shari'a will intensify
the international sanctions that will increase the economic crisis in Iran and
thus Islamic Republic will no longer be facing the innocent high school girls
who have a bit of their hair out of their head scarf but will be facing the
strikes of the lower classes of society. The only winner of the failure of the
negotiations will be those who own a large amount of US dollars hidden as the
dollar's value relative to Iranian toman will be going up.
Before the anniversary of your election to the presidency,
the situation of Iran was accurately explained (1). Unfortunately all the facts
noted in the review have gotten worse today, not better.
It is time that state and Islamic Shari'a to get separated
in Iran. One might ask whether this would mean the end of Islamic Republic? What
has been as the achievements of republicanism during the last 30 and some years
will not be lost and actually will be strengthened, especially what the Iranian
people fought for since 2nd of Khordad. But the mixing of state and Shari'a will
be ended. This does not necessaruly mean bloodshed. Russia and Eastern Bloc
countries ended the Communist state without bloodshed and actually individuals
like Gorbachev and Yeltsin who were high level officials of the Communist Party
were instrumental to make this happen, and prevented a bloody revolution. I hope
Iran can also avoid a bloodshed during its change.
Nine years ago, meaning three years before the Green
Movement, this approach to change was discussed but unfortunately Messrs.
Mousavi and Karroubi did not pay any attention to it, that all political forces
of Iran need to participate in the change for Iran's future whether those who
share in power today, or those who are outside the power structure, and it is
necessary that all work together before a blind bloody uprising burns the whole
Iran in its flames (2).
